Mainly, Wisconsin and Texas are cracking down on popular vaping products. Particularly, in Wisconsin, a new law requires all e-cigarettes (vapes) sold in the State to be FDA-authorized, implying that any vape product not on the FDA’s short list is effectively BANNED and illegal to be sold. Similarly, in Texas, the passed SB 2024 law has become effective; it outlaws most vaping devices containing Chinese-made parts (especially pre-filled disposable vapes) and any products with child-friendly packaging or cannabis ingredients.

Wisconsin Vape Ban 2025: FDA-Authorized Products Only

Actually, Wisconsin didn’t ban vaping or its sales; it simply outlawed products not found on the FDA’s short list. This law has been in place since 2023, prohibiting the sale of any e-cigarette or vaping product not cleared by the FDA.

Vape stores that go against this law face a fine of up to $1,000 per day per illegal item, and enforcement is set to begin September 1, 2025. Scope of the ban:

It’s gon’ be a big blow, sort of.

The Wisconsin vape ban is just one of the growing number of state-level restrictions on vapes. In fact, at the moment, about 14 states have passed similar FDA-authorization laws. Most remain unimplemented, but Wisconsin’s own is about to get serious.

Texas Vape Ban 2025: SB2024’s Broad New Restrictions

Moving over to the big State of Texas, the situation is a bit different than in Wisconsin; the SB 2024 (signed by Gov. Abbott on June 20, 2025) forbids the sale of many e-cigarettes and vapes, mainly disposables and novelty devices. Some excerpts of the SB 2024 law include:

· Ban on devices with Chinese components: As amended, the law makes it illegal to sell any prefilled disposable vape made in or marketed from China, since most disposable e-cigs and many pod systems rely on Chinese parts.

· Packaging and design restrictions: SB 2024 outlaws any vape product with “child-appealing” packaging – for example, cartoon characters, candy or juice imagery, or celebrity logos aimed at kids. It also bans devices shaped like other products (pens, USBs, phones, etc.).

· Cannabis/hemp vapes barred: Any vape that “contains or is marketed as containing cannabinoids” (e.g., THC, CBD derived from hemp) is banned. So hemp-derived THC vapes, kratom vapes, and the like are outlawed. (Non-inhalable hemp products like gummies and prescription medical devices are not covered, though.)

· Steeper penalties: Anyone who goes against the SB 2024’s terms will be charged with a Class A misdemeanor, punishable by up to a year in jail and a $4,000 fine per offense. Sellers will face even harsher penalties, starting September 1, 2025.

So, yeah, starting September 1, 2025, most popular disposables will be banned in Texas, because nearly every vape device has some Chinese-made part; only U.S.-made vapes are legal to be sold.

Oh, Texas isn’t done yet; there’s yet another law—the SB 1316, which bans vape/tobacco ads near schools and churches, and another law considering a flavored-tobacco ban (SB 1182). But at the moment, SB 2024 is the headline because it is set to be effective starting September 1, 2025.

Together, the Wisconsin and Texas laws will swing into action starting September 1, 2025. Apparently, many common e-cigarette devices and flavors will no longer be sold to, or be available in, local stores in those states. Wisconsin retailers could be fined $1,000 a day for going against the law, while in Texas, they could even get jail time.

Are sellers the only ones most affected by these bans? Obviously NO!
